1. Acceptance of Terms

By accessing or using any part of the Eikr platform ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Service.

These Terms constitute a legally binding agreement between you and Eikr Intelligence OÜ, a company registered in Estonia (Reg. 17486797), with registered address at Ehitajate tee 140, Tallinn, Estonia.

2. The Service & Platforms

Eikr operates across multiple platforms. The Service includes AI conversation, real-time web search, image generation, voice input, vision analysis, persistent memory, CRM, and API access — depending on your plan and platform.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Eligibility

You must be at least 13 years old to use Eikr. If you are between 13 and 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements.

4. Accounts & Registration

Access to the Web App requires registration with a valid email address. API access requires issuance of an API key — keys must not be shared or exposed publicly. You are fully responsible for all usage under your credentials.

We may suspend or terminate access if we believe your account is being used fraudulently, abusively, or in violation of these Terms.

5. Subscriptions & Payments

Eikr AI Assistant plans: Basic (€5/mo), Pro (€8/mo), Ultra (€16/mo). Eikr CRM plans: Starter (€19/mo), Growth (€79/mo), Business (€399/mo), Enterprise (custom). API plans start at €29/mo. Prices subject to change with notice.

Subscriptions renew automatically monthly unless cancelled before the renewal date. You may cancel at any time from your profile page.

6. Free Trial

New AI Assistant users receive a 3-day free trial. No credit card required. Available once per user, cannot be transferred or extended. After trial ends, account reverts to free-tier limitations unless a paid plan is activated.

Eikr CRM offers a free plan with limited features. CRM paid plans begin at €19/month.

7. Refund Policy

All payments are generally non-refundable once a subscription is activated. Exceptions may be considered for: a technical failure on our part lasting more than 72 hours; a duplicate payment made in error; or payment made but subscription never activated.

To request a refund, contact eikr.intelligence@gmail.com within 7 days of your payment with your order details.

8. API & Developer Access

API access is subject to these Terms and any additional documentation published at eikr.ee/api-docs.html. You agree not to resell raw API access without written permission, not to use the API to train competing AI models, and to protect your API key from unauthorized access.

We reserve the right to throttle, suspend, or revoke API access for abuse or violation of these Terms without notice.

9. Custom SaaS Solutions

Custom and white-label engagements are governed by separate commercial agreements. Where such an agreement exists, its terms take precedence. Custom SaaS clients are responsible for ensuring their end users comply with applicable usage policies and GDPR requirements.

10. Acceptable Use

You agree not to use any Eikr platform to generate illegal, harmful, or abusive content; violate intellectual property rights; spread misinformation at scale; attempt to reverse-engineer our systems; abuse rate limits; generate content involving exploitation of minors; or impersonate others in a harmful way.

Violations may result in immediate account termination without refund.

11. Intellectual Property

You retain ownership of your inputs and prompts. Eikr Intelligence OÜ retains ownership of the Service, its design, code, branding, and infrastructure. The Eikr name and logo may not be used without prior written permission, except under an approved white-label agreement.

12. Privacy & Data

We store limited data to operate the Service. We do not sell your data or use it for advertising. For full details, see our Privacy Policy. Eikr Intelligence OÜ operates in compliance with the EU GDPR.

13. Disclaimers

The Service is provided "as is" without warranties of any kind. AI-generated content may contain errors or inaccuracies. Eikr is not a substitute for professional legal, medical, financial, or other expert advice. Always verify important information from independent sources.

14. Limitation of Liability

To the maximum extent permitted by law, Eikr Intelligence OÜ shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the 30 days preceding the claim.

15. Termination

You may cancel at any time from your profile page or by contacting us. We reserve the right to suspend or terminate access for violations of these Terms without notice or refund.

16. Changes to Terms

We may update these Terms from time to time. The "Last updated" date will reflect changes. For material changes, we will notify active subscribers. Continued use of the Service constitutes acceptance of updated Terms.

17. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Disputes are subject to the exclusive jurisdiction of Estonian courts. EU consumers may also be entitled to remedies under their local consumer protection laws.
